1. Acceptance of Terms

By accessing or using VocabDuel ("the Service"), operated by Cascade Digital Labs, LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. We will make reasonable efforts to notify users of significant changes.

2. Service Description

VocabDuel is a competitive vocabulary-building application that provides:

  • Curated vocabulary words with definitions, pronunciation, etymology, and examples
  • Solo quizzes with multiple question formats
  • Head-to-head vocabulary challenges between users
  • Competitive ranked seasons with Elo-based rating system
  • Leaderboards and progress tracking
  • Spaced repetition study tools

The Service is provided for educational and entertainment purposes. While we strive for accuracy, we do not guarantee that all vocabulary content (definitions, pronunciations, etymologies) is error-free.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Providing accurate and complete registration information
  • Notifying us immediately of any unauthorized use of your account

You may sign in using your email address, Apple ID, or Google account. We reserve the right to suspend or terminate accounts that violate these terms.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to exploit, manipulate, or cheat the competitive ranking system
  • Send harassing or abusive challenge invitations
  • Use automated tools, bots, or scripts to interact with the Service
  • Interfere with or disrupt the Service or servers
  • Impersonate another person or misrepresent your identity
  • Create multiple accounts to gain unfair competitive advantage

5. Subscription and Payments

VocabDuel offers both free and premium subscription tiers. Premium subscriptions are available as:

  • Monthly: $4.99/month
  • Annual: $39.99/year

Subscriptions are billed through the Apple App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

You can manage and cancel your subscription in your Apple ID Account Settings. No cancellation of the current subscription is allowed during the active subscription period.

6. Refund Policy

As subscriptions are processed through the Apple App Store, refund requests are handled by Apple in accordance with their refund policies. To request a refund:

  • Visit reportaproblem.apple.com
  • Sign in with your Apple ID
  • Select the VocabDuel purchase
  • Follow Apple's refund process

7. Competitive Features and Fair Play

VocabDuel includes competitive features such as head-to-head challenges, ranked seasons, Elo ratings, and leaderboards. By participating in competitive features, you agree to:

  • Compete fairly and honestly
  • Accept the results of matches as determined by our scoring system
  • Not exploit bugs, glitches, or unintended behaviors for competitive advantage
  • Report any suspected cheating or unfair behavior

We reserve the right to adjust ratings, void match results, or suspend accounts in cases of suspected manipulation or cheating. Ranked season results and rewards are determined at our sole discretion.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Cascade Digital Labs, LLC and are protected by copyright, trademark, and other intellectual property laws. The VocabDuel name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cascade Digital Labs, LLC.

9. Challenge Invitations and Communications

When you send a challenge to another user via email, an invitation email will be sent on your behalf through our email service. By using this feature, you represent that you have a legitimate reason to contact the recipient and that the invitation is not unsolicited spam. We reserve the right to limit or restrict this feature to prevent abuse.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the Service's reliability, availability, or fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Cascade Digital Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the appropriate courts.

13. Account Termination

You may delete your account at any time through the app settings or by contacting us. We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.
